Agreement Overview

These Terms of Service ("Terms") govern your use of AgentIzzy, an AI-powered phone agent that answers calls on behalf of your business, captures leads, provides real-time information to callers, and integrates with property management systems. AgentIzzy is operated by Hivetivity, Inc. By accessing or using our service, you agree to be bound by these Terms.

1. Agreement to Terms

By accessing or using AgentIzzy (the "Service"), you agree to be bound by these Terms of Service. If you disagree with any part of the Terms, you do not have permission to access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date.

2. Description of Service

AgentIzzy is an AI-powered phone agent that:

  • Answers incoming phone calls on behalf of your business using artificial intelligence
  • Provides callers with information about your business (hours, services, pricing, policies)
  • Captures lead information from callers and delivers it to you
  • Integrates with property management systems (Storable, storEDGE, SiteLink) to provide real-time inventory and pricing data
  • Transfers calls to your team when configured to do so
  • Generates call recordings, transcripts, summaries, and analytics
  • Handles calls in both English and Spanish

The Service is provided by Hivetivity, Inc. We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.

3. User Accounts

To access the Service, you must create an account at portal.agentizzy.com. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account

You must provide accurate, current, and complete information during registration and keep your account information updated. You must be at least 18 years of age to create an account.

4. Acceptable Use

You agree to use the Service only for lawful business purposes. You may not:

  • Use the Service for illegal, fraudulent, or deceptive purposes
  • Provide false or misleading business information for AI training
  • Use the Service to make outbound calls or for telemarketing
  • Attempt to reverse-engineer, modify, or disrupt the Service or its AI models
  • Exceed the usage limits of your subscription plan
  • Use the Service in violation of applicable telecommunications laws
  • Upload or transmit malicious code, viruses, or harmful data
  • Use automated means to access the Service without our permission

5. Subscription and Payment

The Service is offered on a monthly subscription basis. Current plans include:

  • Starter ($99/month): 100 minutes included, 1 phone number, business knowledge base, lead capture, call summaries, email notifications
  • Professional ($199/month): 300 minutes included, 3 phone numbers, everything in Starter plus warm transfer, bilingual support, CRM integration, priority support
  • Enterprise ($399/month): 1,000 minutes included, 10 phone numbers, everything in Professional plus real-time inventory integration, custom workflows, API access, dedicated account manager

If you purchase a paid subscription:

  • You agree to pay all applicable fees at the rates in effect at the time of purchase
  • Subscriptions automatically renew unless cancelled before the renewal date
  • Overage minutes are billed at the rate specified in your plan
  • Fees are non-refundable except as required by law
  • We may change pricing with at least 30 days' notice
  • You may cancel your subscription at any time through the portal or by contacting us

6. Free Trial

We may offer a free trial period. At the end of the trial, your account will convert to a paid subscription unless you cancel. No charges are made during the trial period. Trial terms may vary and will be communicated at the time of signup.

7. Call Recording, AI Responses, and Data

The Service records and transcribes calls handled on your behalf. You acknowledge and agree that:

  • Call Recording: All calls handled by the AI agent are recorded and transcribed. You are responsible for complying with applicable call recording laws in your jurisdiction, including two-party consent requirements where applicable. We provide configurable call recording disclosures that the AI agent can deliver at the start of each call.
  • AI Responses: The AI phone agent generates responses based on your business knowledge base, connected integrations, and its training. While we strive for accuracy, AI responses may occasionally be incorrect or incomplete. You acknowledge that the Service is an AI system and should not be relied upon as a substitute for human judgment in critical situations.
  • Caller Data: Information provided by callers (names, phone numbers, inquiry details) is captured and made available to you through the portal. You are responsible for handling caller data in compliance with applicable privacy laws.

8. Third-Party Integrations

The Service may connect to third-party management systems (e.g., Storable, storEDGE, SiteLink) at your direction. You are responsible for:

  • Maintaining valid credentials and API access for connected systems
  • Authorizing the data access required for real-time inventory queries
  • Ensuring your use of the integration complies with the third party's terms of service

We are not responsible for the availability, accuracy, or performance of third-party systems. Integration features require an Enterprise plan or higher.

9. User Content and Business Data

You retain ownership of any content you create or upload to the Service ("User Content"), including business knowledge base entries, custom Q&A, policies, and configuration data.

By uploading User Content, you grant us a limited license to store, process, and use your content solely for the purpose of providing the Service — including using your business information to train the AI agent to answer calls accurately on your behalf.

You are solely responsible for your User Content and represent that:

  • You have the right to provide such content to us
  • Your content is accurate and not misleading
  • Your content does not violate the rights of any third party
  • Your content complies with these Terms and applicable laws

10. Intellectual Property

The Service and its original content (excluding User Content), including its AI models, algorithms, software, documentation, features, and functionality, are and will remain the exclusive property of Hivetivity, Inc. and its licensors.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent. Your business data and call recordings remain your property.

11. Service Availability

We strive for high availability but do not guarantee 100% uptime. We are not liable for service interruptions caused by:

  • Telecommunications provider outages or issues
  • Third-party integration downtime or errors
  • Scheduled maintenance (we will provide reasonable advance notice)
  • Force majeure events or circumstances beyond our reasonable control

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
  • AI-GENERATED RESPONSES WILL BE ACCURATE, COMPLETE, OR APPROPRIATE IN ALL CIRCUMSTANCES
  • THE SERVICE WILL CAPTURE ALL INCOMING CALLS OR LEADS
  • REAL-TIME INVENTORY DATA FROM THIRD-PARTY SYSTEMS WILL BE ACCURATE
  • ANY ERRORS IN THE SERVICE WILL BE CORRECTED

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HIVETIVITY, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, INCLUDING BUT NOT LIMITED TO:

  • LOST REVENUE FROM MISSED CALLS OR INACCURATE AI RESPONSES
  • DAMAGES RESULTING FROM INCORRECT INFORMATION PROVIDED BY THE AI TO CALLERS
  • DAMAGES RESULTING FROM THIRD-PARTY INTEGRATION FAILURES OR DATA INACCURACIES
  • DAMAGES RESULTING FROM CALL RECORDING OR TRANSCRIPTION ERRORS

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to defend, indemnify, and hold harmless Hivetivity, Inc. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your User Content or business information provided to the AI
  • Your failure to comply with applicable call recording or telecommunications laws
  • Claims by callers related to information provided by the AI on your behalf

15. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms or non-payment.

You may cancel your subscription at any time. Upon termination:

  • Your right to use the Service will immediately cease
  • Your phone number(s) will be released
  • Access to call data, transcripts, and analytics will be available for 90 days, after which it may be deleted
  • You may request export of your data during the 90-day period

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Hivetivity, Inc. is a Delaware C Corporation.

Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Fulton County, Georgia, and you consent to the personal jurisdiction of such courts.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date and providing at least 30 days' notice via email before changes take effect.

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

18. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your personal information, including call data and caller information.
